Thanks for writing.

    because the Kpathsea library manual (for v 3.5.6) did not give any
    indication about it. 

The kpse version distributed with TL 2008 is 3.5.7.  That is when the
Windows-specific behavior of ~ was implemented.

    A sentence about this behavior in section 3.3.3 of
    this document would be helpful.

Indeed, in the v3.5.7 version, I had added this sentence:
  On Windows, the environment variable `USERPROFILE' is checked instead
  of `HOME'.
