The simplest way would be to write them a letter along the lines:

"We've noticed that in ... you claim copyrights for ... as well as you 
forbid your buyers to make copies of it ... . Since we consider this 
unacceptable, before seeking legal counsel, we would like to hear your 
opinion on this as well as a to receive a proposal on how to correct this 
in current publications and prevent similar things in future publications."

so, let's see how willing they are to compensate
