well, windows can do both: you can have two files with different case present (ls-r and LS-r for instance) but by default it serves its users well by letting them assign case sensitive to files but treat them as caseless; so it's not that bad after all; and in the end, file systems will become like databases and things will become less 'related to personal views on what os did whatever best) ...
