I don't know why that would be, but FYI, in TL'08, I changed kpsewhich
to know the right formats for the common config files (config.ps
dvipdfmx.cfg fmtutil.cnf glyphlist.txt mktex.cnf pdfglyphlist.txt
pdftex.cfg texmf.cnf updmap.cfg) by default, so you don't need to
specify a --format at all.

Also, you can use --all to report all the matches for a file (useful
mostly for debugging "shadow" files, as you seem to have here).
  
Finally, note that kpsewhich --debug=-1 ... will report just about
everything that is being done.

>From your message, I also discovered that something like
kpsewhich --format=junk foo.tex
does not give an error message.  (It just defaults to "tex".)  Too late
to fix that now, but I will eventually.
