Nonfree packages must be removed.  It's purely an accident and a mistake
that they were ever in TL -- if we had discovered that package foo was
nonfree on August 3 instead of October 3, they would have not been in
the 2008 distribution; we did remove many packages found to be nonfree
over the year, so presumably your problems could occur with those just
as well as those found after the ISO image was made.  There's no
rationale for them to stay around just because we didn't realize the
problem before an arbitrary cut-off date.  In some cases, it could have
been technically illegal for us to distribute them to you in the first place.

Manuel also pointed a completely different technical reason why removals
need to happen.

If your situation is so sensitive to missing packages, then I strongly
urge that you back up the packages so you can keep them in texmf-local,
as Manuel also suggested.

Or use tlmgr update --no-remove.  Or don't update.
