I agree. Like you I think that lua-files connected with an exe (like
mkluatexfontdb.lua) should go to /scripts, while the .lua files used
as "normal" inputs by packages should go to /tex like fontspec.lua
or the input files of luaotfload.

But I don't think that there is a policy. The files are put where
the package authors suggest.
