[pretest] \latelua broken

The following plain luatex file fails for me on windows 

abc \latelua{}

\bye

With tl2022 there is no problem. 

This is LuaTeX, Version 1.16.0 (TeX Live 2023)  (format=luatex
2023.2.21)  21 FEB 2023 16:09
 restricted system commands enabled.
